A Step-By-Step Guide To Starting Your Divorce

Step 1:

Consultation with an attorney – Research the attorneys that practice family law in your area. Ask friends and associates you trust for their references. Make an appointment for a consultation. Most attorneys charge for consultations in domestic matters. Make sure you understand what the costs of the consultation are and what you need to bring with you to the consultation.

Step 2:

Retain an attorney – This is among the most important decisions you will make. You need to make sure you are comfortable with the attorney and their support staff before you hire the attorney or firm. Take your time.

Step 3:

Fill out information packet – If you choose to retain Benton Family Law, you will be given an information package to fill out and return. Collect all information requested by the attorney and return it a promptly as possible.

Step 4:

Initiate divorce actions – If you retain our office together we will decide the best way to proceed. The normal options are:

  • Write a letter to the spouse; or
  • Begin negotiations with counsel for the spouse; or
  • File legal action;

Which step and when to move forward will be based on a case by case basis and only after the client and attorney agree.
